Electronic Consent Agreement

This Electronic Consent Agreement (“Agreement”) explains your rights when receiving disclosures, communications, and documents electronically from LoiNow.com (“LoiNow,” “we,” “us,” “our”).
By accessing LoiNow.com, submitting a loan inquiry, or continuing to interact with us electronically, you consent to the use of electronic records, signatures, and communications as permitted under:
- Electronic Signatures in Global and National Commerce Act (E-SIGN Act)
- Uniform Electronic Transactions Act (UETA)
- FTC E-Signature Guidelines
- State and federal lending regulations
This Agreement applies to all interactions between you and LoiNow related to business-purpose loan inquiries, underwriting, and ongoing communications.

By using LoiNow.com you agree to receive the following electronically, instead of in paper form:
- Loan program information
- Disclosures and notices
- Letters of Intent (LOIs)
- Preliminary term sheets
- Required regulatory communications
- Underwriting requests
- Agreements, forms, and documents
- Updates to policies and terms
- General business correspondence
Electronic delivery may occur via:
- Secure portal (if applicable)
- Website notifications
- PDF or digital documents
- SMS (informational notices only)
2. Your Right to Withdraw Consent
You may withdraw your consent to electronic communications at any time by emailing:

Important:
Withdrawal of consent may:
- Delay processing of your loan inquiry
- Limit our ability to provide services
- Prevent issuance of LOIs or term sheets electronically
There is no fee to withdraw consent.
3. Hardware & Software Requirements
To access and retain electronic records, you must have:
Hardware Requirements
- Computer, tablet, or smartphone
- Active Internet connection
Software Requirements
- Browser such as Chrome, Safari, Edge, or Firefox
- Ability to view PDF documents
- An active email address
- Storage capability for saving documents
- Printer (if you wish to print documents)
You affirm that you can access these materials electronically.
4. Updating Your Contact Information
You agree to keep your contact information accurate.
To update your email or communication preferences, contact:

LoiNow is not responsible for communications not received due to outdated or incorrect information.
5. Requesting Paper Copies
You may request a paper copy of any electronic record.

Fees:
- LoiNow does not charge for paper copy requests, but
- Shipping charges may apply depending on location
Paper copies will be mailed within 10 business days.
6. Scope of Consent
Your consent applies to:
- All loan-related communication
- Business-purpose loan documents
- Regulatory notices allowable under E-SIGN
- Updates to agreements and disclosures
Your consent remains valid unless withdrawn in writing.
7. Electronic Signatures
By using LoiNow.com, you agree that:
- Typing your name, clicking a checkbox, or digitally signing
- Has the same legal effect as a handwritten (“wet”) signature
Electronic signatures are legally enforceable under:
- E-SIGN Act
- UETA
- State contract law
8. Security of Electronic Communications
LoiNow maintains security protocols including:

- GLBA-compliant safeguards
- Limited access controls
However, email communications may not always be fully secure. Avoid sending sensitive data unless requested through secure means.
9. No Consumer Lending
This Agreement applies only to business-purpose financing.
LoiNow does not originate consumer loans or owner-occupied mortgages.
10. Changes to This Agreement
LoiNow may update this Electronic Consent Agreement as required by law or platform improvements.
Changes will be effective immediately upon posting.
